Terms of Service

1. Acceptance

By accessing or using MedAgent ("Service"), you agree to these Terms. If you represent an organization, you confirm authority to bind that organization.

2. Service Description

MedAgent provides AI-powered document processing and clinical decision support for healthcare organizations. The Service includes:

• Community (Free) — Self-hosted, open-source, MIT licensed
• Cloud SaaS ($49/mo) — Managed hosting with support
• Enterprise ($500/mo) — On-premise with dedicated support
• Custom — Project-based deployment and integration

3. Medical Disclaimer

MedAgent is NOT a medical device. All AI-generated responses are for informational purposes only and must be verified by qualified healthcare professionals before clinical use. MedAgent does not provide medical diagnoses, treatment recommendations, or clinical decisions.

4. Data Privacy & Security

• Self-hosted: All data stays on your infrastructure. We have zero access.
• Cloud SaaS: Data is encrypted at rest (AES-256) and in transit (TLS 1.3). See our Privacy Policy.
• We never use customer data for AI model training.
• You maintain full ownership of your data at all times.

5. Compliance

MedAgent provides compliance configuration tools for HIPAA, GDPR, APPI, PIPA, and Vietnamese data protection laws. However, compliance is a shared responsibility — you must ensure proper configuration, access controls, and organizational policies for your jurisdiction.

6. Payment Terms (Cloud SaaS & Enterprise)

• Billed monthly. Cancel anytime — no long-term contracts.
• 14-day free trial for Cloud SaaS (no credit card required).
• Refunds processed within 30 days for annual plans.
• Prices may change with 30 days' notice.

7. SLA (Cloud SaaS & Enterprise)

• Cloud SaaS: 99.9% uptime guarantee.
• Enterprise: Custom SLA per agreement.
• Scheduled maintenance windows communicated 48 hours in advance.

8. Acceptable Use

You agree not to:

• Use the Service for purposes other than healthcare operations
• Attempt to reverse-engineer proprietary components
• Violate applicable healthcare data protection laws
• Share credentials or access tokens

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDAGENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO CLINICAL DECISIONS MADE BASED ON AI-GENERATED RESPONSES.

10. Termination

Either party may terminate at any time. Upon termination of paid plans, we provide 30 days to export your data. Self-hosted installations are unaffected by termination.

11. Changes

We may update these Terms with 30 days' notice via email. Continued use after changes constitutes acceptance.
